Court changes its mind: Construction of American LNG project emerging out of legal woods

NextDecade Corporation Celebrates Court Decision on LNG Export Projects

Houston-headquartered energy player NextDecade Corporation has welcomed a recent court judgment regarding its liquefied natural gas (LNG) export projects at the Port of Brownsville, Texas. The decision has cleared the way for the construction of the Rio Grande LNG project, removing uncertainties that arose from previous legal challenges.

The Rio Grande LNG project in Texas is strategically positioned to benefit from the Trump administration’s focus on energy dominance, with LNG playing a pivotal role in the country’s energy strategy.

Despite facing opposition from environmental groups, the project has persevered through legal obstacles. The U.S. Court of Appeals for the D.C. Circuit’s ruling in August 2024 initially posed challenges by requiring a supplemental environmental impact statement (EIS) for the project’s reauthorization.

Following the court’s decision, FERC initiated the process of preparing a supplemental EIS to address the concerns raised. NextDecade took proactive steps by filing petitions and engaging with regulatory authorities to address the legal hurdles.

On March 18, 2025, the U.S. Court of Appeals for the D.C. Circuit revised its judgment, allowing construction to proceed at the Rio Grande LNG facility without further delays. This development was met with enthusiasm by NextDecade’s leadership, including Chairman and CEO Matt Schatzman.

Commercial progress for the project is evident, with agreements in place for LNG sales and purchase with key partners like ADNOC, Aramco, and TotalEnergies. The company is also advancing plans for additional liquefaction trains to expand the facility’s capacity.

NextDecade’s commitment to environmental sustainability is reflected in its carbon capture and storage (CCS) initiatives, aimed at reducing emissions significantly. The company’s focus on innovation and efficiency sets the stage for the Rio Grande LNG project to become a leading player in the global LNG market.
