MarineMax Settles Data Breach Class Action Lawsuit for Over $1 Million
MarineMax has reportedly agreed to pay over $1 million to settle a class action lawsuit stemming from a 2024 data breach that exposed sensitive customer information. The breach allowed hackers to access details such as social security numbers, driver’s license numbers, and bank account information.
The settlement, totaling $1,018,825.50 according to Top Class Actions, resolves claims that MarineMax failed to implement reasonable cybersecurity measures that could have prevented the breach. MarineMax, a leading retailer of recreational boats and yachts with locations across the United States, has not admitted any wrongdoing in agreeing to the settlement.
MIN has reached out to MarineMax about the settlement and has yet to receive a response.
Marinemax Data Breach Settlement
On 10 March 2024, MarineMax notified individuals that the company had experienced a data breach after an unauthorized party accessed sensitive consumer data entrusted to the company.
Individuals eligible for compensation are those who received a data breach notification letter from either MarineMax or the financial and insurance services firm Newcoast. Eligible claimants may receive up to $5,000 for documented identity theft losses and up to $2,000 for documented out-of-pocket expenses, which may include costs such as professional fees, credit expenses, and monitoring services.
Those who did not previously opt into MarineMax’s initial offer of two years of credit monitoring can now receive up to three years of one-bureau credit monitoring. Individuals who accepted the original credit monitoring offer can receive an additional 12 months of coverage.
After deducting payments for identity theft, out-of-pocket expenses, and credit monitoring, the remaining funds will be distributed on a pro-rata basis among claimants. This could be as much as $500 per person, according to The Sun.
To receive benefits, class members must submit a valid claim form by 13 June 2025.
The final approval hearing for the MarineMax data breach is scheduled for 17 June 2025, in the United States District Court for the Middle District of Florida, Tampa Division, under the case name Lomedico, et al. v. MarineMax Inc., et al., Case No. 8:24-cv-01784-CEH-JSS.
Class action lawsuits offer groups of people, or ‘classes,’ a way to band together in court. These suits are often brought by one or a few people who allege a company or other entity has wronged a large group. When a suit becomes a class action, it extends to all ‘class members,’ or people who may have similar complaints.
