Indian Authorities Launch Criminal Case Against Owner, Master, and Crew of MSC Elsa 3

Indian authorities have taken decisive action against those responsible for the sinking of the containership MSC Elsa 3 off the coast of Kochi last month. The vessel met its unfortunate fate on May 25, 2025, approximately 13 nautical miles off Kerala’s coast, after developing a severe starboard list a day earlier during its journey from Vizhinjam to Cochin.

All 24 crew members were successfully rescued by the Indian Coast Guard, but the aftermath of the incident has led to legal repercussions for the owner, master, and crew members of the vessel. Charges have been filed under various sections of the Indian Justice Code, including reckless navigation, endangering public ways of navigation, and negligent handling of hazardous substances.

The First Information Report (FIR) highlights the negligence of the accused in operating the vessel despite being aware of the presence of hazardous and inflammable materials onboard. This negligence resulted in the loss of containers and the release of hazardous plastics into the coastal waters, causing environmental damage, disrupting local fishing activities, and blocking shipping lanes.

Of particular concern are 13 containers classified as hazardous cargo containing Calcium Carbide, a substance that can react violently with water and release flammable gases. The potential risks posed by such cargo emphasize the gravity of the situation.

An investigation was promptly initiated on June 10 following directives from the Inspector General of Kerala Coastal Police. Authorities are set to gather statements from MSC shipping representatives, the vessel’s captain, and crew members to ascertain the circumstances leading to the incident.

Meanwhile, salvage operations are underway, with a 48-hour deadline imposed to recover oil from the sunken vessel before the onset of monsoon conditions. The urgency of the situation underscores the need for swift and effective action to mitigate further environmental damage and ensure maritime safety.
